Why expatriates facing legal problems?

Most of the expatriate workers are facing some kind of the legal problems at least once in their job period in kingdom of Saudi Arabia as well as other GCC countries. It is common in private sector that, employees are facing contractual violation problems with their employers. Many employers in private sector send back their employees without mentioning any specific reason or without making them aware of their rights. Normally they are not getting proper remedy from their employers as well as other authorities.  


There are many reasons behind it. The primary reason is ignorance. It is applicable for all employees irrelevant to their job profile, such as a General Manager as well as a normal driver. Most of the employees do not know how to lodge a complaint against the violations or where to go to obtain their legal rights. Even though some of them approach the authorities, most occasions they will approach the wrong authorities, they are helpless to provide remedies to them. In some cases, even if the expatriate worker knows very well in regard to his rights, he may be reluctant to approach the concerned authorities due to fear and financial burden etc. some of the common reasons restrict employees to seek legal remedies to approach proper authorities are mentioned below.

A recent study revealed that almost 90% of the GCC workers are never read the Labour laws of the concerned countries, even though which are available at a free of cost in the modern communication medias. This ignorance from the part of employer’s as well as employees is main reason behind the increasing number of labor disputes. Among the expatriates communities - like, Filipino, India, Pakistan, Bangladesh, Sri Lanka, Nepal and Indonesia - Filippino workers are the exemptions. They are more aware about their legal rights. They are very keen to keep their duty hours also very keen to ask their rights. 


Tens of thousands of work related litigations pending in Kingdom itself and most of the litigations resulted due to the mismanagement or management failure to obey the rights of employees ensure by the statutes. It leads to a loss of Millions of riyals every year to the private sector. There is only one remedy. Employees need to understand their duties, responsibilities and rights. Nobody can help them, if they are not taking any initiative.
